When the Alabama workers' compensation statute was amended to allow employers and insurers a right of subrogation and offset in third-party lawsuits, we successfully argued to the Alabama Supreme Court that employers and insurers enjoyed that same right for future medical benefits. This changed the law in Alabama, and put the responsibility of future medical payments on the third-party tort-feasor instead of the innocent employer/insurer.
We have also represented insurers and employers in complex claims involving the application of Alabama's Last Injurious Exposure Rule. This doctrine applies when a claimant has sustained more than one injury during more than one employment or coverage period, and the court is required to assign responsibility for the claim to the proper employer or carrier.
Another part of our workers' compensation practice is to assist employers, insurers, and administrators in resolving disputes regarding medical care and vocational retraining benefits, which can be more problematic than the claim itself. We also represent employers, insurers, and co-employees in a variety of claims which arise from the Alabama Workers' Compensation Act, such as Retaliatory Discharge claims, Co-employee "Willful Conduct" claims, and claims involving removal of safety guards.
